To be eligible, you must have EITHER An Advanced Degree OR Exceptional Ability in your field AND your business endeavor in the United States must meet these three criteria: 1. Your endeavor has substantial merit and national importance. 2. You are well-positioned to advance the proposed endeavor; and 3. It is in the national interest of the United States to WAIVE the typical requirements of a job offer and labor certification. THE E2 VISA IS A WIN-WIN FOR YOU AND THE USA Arguably the best visa for most foreign entrepreneurs and Americans is the E2 investor visa. The E2 visa allows foreign entrepreneurs to enter the United States by investing at least $100,000 in a startup enterprise or buying at least 50% of an existing business, and staying in the country to direct and develop its operations. This isn’t some visa where a foreign entrepreneur enters the United States and sets up a business that generates just enough revenue for him and his family to survive. On the contrary, the foreign entrepreneur must invest a substantial amount in the U.S. business. He or she needs to establish it, direct it, grow it, and hire Americans. I love working on E2 investor visa projects because I get to help foreign entrepreneurs achieve their American dream while helping Americans get hired and improving the economy overall. I think we need more E2 visa investors and investment. How about you? Let me know me in the comments below. https://bovinolawgroup.setmore.com #e2visa #investorvisa #usimmigration #immigrationlawyer #e2visarequirements #fyp

5 TIPS FOR ENTERING THE GREEN CARD LOTTERY IN 2023 The U.S. Department of State administers the Diversity Immigrant Visa Program - also known as the "Green Card Lottery" - which makes up to 55,000 green cards available every year to qualified applicants from countries with low rates of immigration to the United States. Here are 5 tips for entering in 2023: 1. Ensure that your country is eligible 2. Ensure that you meet the education or work experience requirement In addition to the nationality requirement, you must possess: at least a high school diploma or its equivalent OR two years of work experience in an occupation that requires at least two years of training or experience 3. Enter ASAP: You must submit your entry to the program this year between noon on October 4, 2023 and noon on November 7, 2023. It's FREE, you can do it yourself, and there's only one place to apply. Here's the URL: https://dvprogram.state.gov 4. Don't submit more than one entry per person If you submit more than one entry per person, all of your entries will be disqualified. However, if you're married, your spouse can apply separately. And if you have any children who meet the eligibility requirements, they can apply separately as well. 5. Follow the photo submission instructions carefully You must submit a valid photo in strict accordance with the instructions. If you don't, they'll reject your entire application. 5 WAYS TO LOSE YOUR GREEN CARD Number 1: Living Outside of the US for Too Long If you're a green card holder who decides to live outside of the US for more than a year, an officer of Customs and Border Protection (or CBP) can trigger processes to revoke your green card and deport you. This can happen after shorter absences from the U.S. as well, especially those that exceed 6 months. Fortunately, there's a simple solution. If you know that you're going to be out of the country for an extended period of time, apply for a Reentry Permit before departure. It's valid for two years. Number 2: Voluntarily Surrendering Your Green Card If you don't want to pay U.S. taxes or just don't want to be a permanent resident anymore, you can file a form I407 to voluntarily surrender your green card. But don't be pressured or tricked by a CBP officer into doing this if you don't want to. Insist on speaking with an immigration attorney and a hearing in front of a U.S. immigration judge, where you'll at least have an opportunity to fight for your green card and permanent resident status. Number 3: Being Convicted of a Crime If you're caught selling or using drugs or committing some sort of felony, you can lose your green card and be deported. Number 4: Commiting Fraud Fraud or willful misrepresentation can lead to loss of your green card and deportation, too. Fraud comes in many forms, such as marriage fraud, lying about your intent when applying for a nonimmigrant visa, or perhaps worst of all, posing as a U.S. citizen in order to cast a fraudulent vote in a U.S. election. Number 5: Failing to Remove Conditions on Permanent Residence If your green card is conditional and valid for only two years - such as if your green card was based on marriage that was less than two years old when you got it - you can lose it and be deported if you don't file a petition to remove those conditions during the 90-day period immediately before your conditional residence expires. #greencard #permanentresidency #immigration #immigrationlawyer #reentrypermit #fyp

Breaking News: Biden’s Migrant Crisis Costs American Taxpayers Almost Half a TRILLION Dollars Per Year President Joe Biden's migrant crisis at the southern border will cost U.S. taxpayers almost half a TRILLION dollars per year, according to a new report by the House Subcommittee on Homeland Security. The report details the immense financial costs of the unprecedented border crisis being borne by American taxpayers, including the costs for health care, shelter, education, and law enforcement, as well as costs forced on private property owners and businesses. According to the report, there are between 16.8 million and 29 million illegal migrants living in the United States, and the $31 billion in taxes they pay annually only partially offsets the staggering costs. As a U.S. immigration lawyer, I obviously support and facilitate legal immigration because, in most cases, it's a win-win. But this report shines some much-needed light on the costs of Biden's open-border policies at a time when most Americans want something to be done about it. HOW TO GET AN O1 VISA LIKE MESSI Can you get an O1 visa like Messi reportedly received to enter the U.S. and play soccer for Inter Miami CF? This photo of Messi's O1 visa shows his last name as "GOAT," so it's a fake. But that's not important right now. What’s important is that you don't need to be as extraordinary as Messi to qualify for an O1 visa, which is vastly underutilized by the best and brightest around the world. You just need to satisfy at least 3 of the following 8 criteria: 1. Awards for Excellence Have you recieved any nationally or internationally recognized awards for excellence? If you raised venture capital, that counts as an award, by the way. 2. Membership Are you a member in associations in your field that require outstanding achievements of their members? 3. Press Has there been any press in professional or major trade publications or other major media about you relating to your work in the field? 4. Critical or Essential Employment Have you been employed in a critical or essential capacity by any orgainizations with a distinguished reputation? 5. High Remuneration Have you commanded a high salary or will you command a high salary or other remuneration for your services? 6. Judging Have you ever been a judge of other entrepreneurs or startups in your industry? 7. Original Contributions Have you made any original contributions of major significance in your industry? 8. Scholarly Articles Have you authored any scholarly articles about your area of expertise? Finally, please note: If you graduated from a prestigious startup accelerator, you probably satisy at least 4 of those criteria. So, if you'd like to bring YOUR extraordinary ability to Team USA, use the link in my bio to schedule a video consultation. HOW TO GET YOUR GREEN CARD THROUGH MARRIAGE Here’s how to get your green card through marriage to a US citizen: In short, you need to show a bureaucrat at USCIS that your marriage isn’t fraudulent or, in other words, that you didn’t get married just to get a green card And you do THAT by submitting A LOT of persuasive evidence that your marriage is in fact bona fide and legitimate, such as: * a joint lease, rental agreement, mortgage or some other proof of living together * photos of your wedding, and other photos of the two of you with family and friends * shared bank accounts, credit card accounts, or other financial accounts * statements from close friends and family members who can attest to the legitimacy of your marriage * shared life and/or health insurance policies * birth certificates of children you had together (if any) * a pre-nuptial agreement, or * anything else you can muster up to show that you have a shared life together as a married couple This is Joseph Bovino, US immigration and business attorney Let me know what you think in the comments below, and follow for more #greencard #greencardmarriage #greencardlawyer #immigrationlawyer #immigration #fyp

U.S. Sets New Record for Issuance of Nonimmigrant Visas in 2023 Did you know that the U.S. Department of State issued a decade-high 10.4 million nonimmigrant visas in 2023? Well, it's true, according to the latest official figures, and 40% of those nonimmigrant visas were processed without in-person interviews. The U.S. Department of State also issued 563,000 immigrant visas (or green cards) during 2023, reducing the immigrant visa backlog by almost 50%. And 590,000 nonimmigrant and immigrant visas were issued last year to high-skilled workers and executives - the most ever. So, if you're interested in legal immigration—that is, applying for a nonimmigrant or immigrant visa through the appropriate legal channels—things are looking up. YOUR OBLIGATION TO ASSIMILATE AS A NEW U.S. CITIZEN You’d amazed by the range of countries represented at a US Citizenship ceremony, but you'll soon discover that it's definitely NOT a multicultural affair. On the contrary, you'll swear an Oath of Allegiance, absolutely renouncing ALL ALLEGIANCE TO ANY FOREIGN PRINCE, POTENTATE, STATE, OR SOVEREIGNTY and swearing to BEAR ARMS ON BEHALF OF THE UNITED STATES WHEN REQUIRED BY THE LAW. You'll recite the pledge of alligiance to the American flag and the republic for which it stands, ONE NATION, UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. And finally, you’ll hear a congratulatory message from the President of the United States, such as these words by President Trump: THIS COUNTRY IS NOW YOUR COUNTRY. OUR HISTORY IS NOW YOUR HISTORY. AND OUR TRADITIONS ARE NOW YOUR TRADITIONS. YOU NOW SHARE AN OBLIGATION TO TEACH OUR VALUES TO OTHERS, TO HELP NEWCOMERS ASSIMILATE TO OUR WAY OF LIFE. I love that because US immigration isn't just about entry and diversity - at least not to me - it's about American values, traditions, and assimilation.
