On February 6, 2024, BET Investment presented to the #Newtown Planning Commission a revised plan for Newtown Corners, now called “Newtown Place.” The owner seeks a text amendment to the Joint Municipal Zoning Ordinance (JMZO) to allow a “Parking Core Apartment Building” in the TC (Town Center) district of Newtown Township. The current zoning does not allow for such a structure. Consequently, BET proposes to add this “B-11” use to the JMZO. This is a recording of the Q&A session. At the 22 May 2023 Meet Mack Monday Zoom meeting, residents discussed the pros and cons of reducing speed limits to improve pedestrian safety. The discussion focused on Newtown-Yardley Rd between Lower Dolington Rd (LDR) and Washington Ave in the Borough and LDR along the soon-(hopefully)-to-be-completed multi-use trail. Should pedestrians just jump in front of cars at crosswalks and expect them to stop in time? Pedestrian-activated flashing beacons might help as well as better enforcement of the lower speed limit. Dolington Rd may be next to see a lower speed limit, but is the township going too far in reducing the speed limits on roads?

At the April 24, 2023, Meet Mack Monday Zoom meeting, Cindy Neutson expressed concern about speeding and pedestrian safety on Lower Dolington Road (LDR), especially along Roberts Ridge Park. Frank McCarron suggested that the speed limit be reduced to 25 MPH as it was on Newtown-Yardley Rd and Sycamore St. I am not against this idea but I suggested that the best time to bring up this issue with the township is AFTER the LDR trail is finished. At that point there will be more pedestrian traffic and more urgency to improve pedestrian safety as well as enforcing the speed limit.

Mack's Newtown Voice - Provco's E30 Validity Challenge at ZHB: Part 2

At a special session of the Newtown Township Zoning Hearing Board (ZHB) on January 30, 2023, Provco/Wawa appealed the ZHB's 2021 denial (see sco.lt/6Eh7rM) of all signage and fuel dispenser variances to the JMZO E30 zoning ordinance. Provco is challenging Section 803.E.30.3, Section 1103.CA, and Section 1101.A of the ordinance, as "arbitrary, unreasonable, and not substantially related to the purposes of the Pennsylvania Municipalities Planning Code (MPC), or the public health, safety, or welfare of Newtown Township that the JMZO purports to serve." Specifically, Wawa wants to have 8 fueling dispensers (16 pumps) whereas the E30 ordinance allows only 6 and it wants signage facing or visible to the Bypass, which is also prohibited by Newtown zoning codes. John Van Luvanee, attorney for Provco/Wawa presented two expert witnesses to testify at the ZHB hearing. This audio snippet features the testimony and cross-examination by Newtown Township's Solicitor (Dave Sander) of expert witness Mr. Mike Redel, a Real Estate Project Engineer employed by Wawa. Peter Nelson, an attorney representing Upper Makefield Township was a party to the case and also cross-examined Provco's witnesses at the hearing. The hearing was very similar - hence, Deja Vu All Over Again - to the first hearing before the ZHB on May 6, 2021 (www.johnmacknewtown.info/zhbwawarnd1.html). This time, however, Proco/Wawa is challenging the validity of the E30 ordinance, which it is also pursuing in a court case. If it wins that case, none of the restrictions of the E30 ordinance would apply such as the right of the Supervisors to limit the hours of operation because there is a "residential use" within 750 feet of the property.

On December 20, 2022, the KRE Group presented to the Newtown Planning Commission a plan for development of 17.87 acre parcel in the OR, Office Research, Zoning District to construct a luxury rental apartment building with 225 units, 244 surface parking spaces and 232 garage parking spaces. Synopsis by PC Chair Peggy Driscoll: The Jointure does not permit such a residential use in any of our zoning districts. Attorney Ed Murphy indicated that the plan would require a zoning amendment, which the applicant preferred over a use variance. The Commission members had many concerns about the size and intensity of the project and had many questions about traffic, economic impact, and preservation of wetlands and woodlands. We discussed the impact of such a large building on the school district. The sketch plan seemed to indicate that the appearance from the bypass would be relatively unchanged. The applicants presented a series of photographs of a similar project in Bedminster, New Jersey, which seemed to feature some commercial components but there are no plans for commercial uses, like a coffee shop of café at this development. As this was a very preliminary presentation, the applicants plan to take the Commission’s comments and questions and attempt to address them, providing some additional information of traffic studies and demographics of prospective tenants. The Commission members were generally hesitant to support such a complete change in existing zoning, however we are willing to continue to work with the applicant and learn more about their plans and their successes in other municipalities. Other issues/comments: • Building Height Some of the sketch plan documents refer to a five story apartment complex, which is strictly prohibited in Newtown Township because of fire department ladder limitations. The proposed apartment complex is actually 4 stories although the height of the building – 51 feet – was of some concern to PC members. • Traffic and Access to Newtown Amenities There was much discussion about traffic issues. The developer said that a Traffic Impact Study (TIS) would be made and that the May 12, 2022, TIS by TPD (which prepared the Provco/Wawa TIS) was not applicable. It was suggested than many millennials (potential renters) do no own cars and perhaps there should be amenities (e.g., coffee shop) on site. I suggested that many tenants would be into biking and that perhaps a bike lane would be needed on Lower Silver Lake Rd to allow access to Wawa, which is sure to be coming down the road. Also, mentioned was the problem of crossing the Bypass by bike to Newtown-Yardley Rd (NTYR). That would mean that residents with cars would drive into town via NTYR exacerbating the pedestrian crosswalk problem at Newtown Walk – we all know millennials tend to speed when driving! • Environment I expressed concern about the watershed and basin currently located on the site. The plan seems to cover over the basin. I also mentioned that many trees would have to be removed and suggested that the developer offer to contribute money to the Newtown “Tree Bank” to plant replacement trees in public areas. This was something the NAC had promised some time ago when it removed trees from its property. NOTE: THE PLANNING COMMISSION DID NOT VOTE TO MAKE AN OFFICIAL RECOMMENDATION TO THE BOARD OF SUPERVISORS.

Resident Terry Christensen spoke up in favor and Supervisor-elect Elen Snyder vowed to "make it happen." Mack also suggested that the township's audio/visual equipment needed to be updated.
