I also just wanted to expand on my first amendment point that obviously there are exceptions to the rule. Hate speech, incitements of violence, things like that can be prohibited – none of which Dumbledore is doing. Some speech is also restricted based on national security, despite what the first amendment says. One of the sources I looked at states, “generally, a person cannot be held liable, either criminally or civilly for anything written or spoken about a person or topic, so long as it is truthful or based on an honest opinion and such statements.” (Cornell Law School source)
We know the Dumbledore is being truthful. So there’s really no reason for Dumbledore to be thrown in Azkaban. However, even though the above talks about truthful or honest opinions, given the amount of misinformation that has been able to slide in recent years here, I still doubt that Dumbledore would get thrown into jail even if Voldemort being back was BS.
