Amy Lord Part 2-Amy's killer should have been imprisoned previously, why wasn't he??

Amy's killer had struck in a similar manner less than a year prior. Alemany had actually left his ID (wallet) on top of an unconscious victim. Both the victim and a passerby gave accurate physical descriptions, why wasn't Alemany arrested and charged with this brutal assault? He would likely have not met bail conditions and would have been held awaiting trial, when Amy's murder was committed. Be advised this episode contains graphic violence.
