A Miami judge has denied Zion Williamson’s request to delay discovery into Gina Ford’s allegations that he received improper economic benefits to attend Duke. As a result, Williamson must now answer these questions under oath within the next 2 weeks. That is, unless Williamson’s attorneys file an immediate appeal, which is expected. Sports law expert Dan Lust joins me to break down the court ruling and discuss the likely next steps, including a possible appeal and whether it will be successful.

Did Zion Williamson receive improper payments or other economic benefits to attend Duke? His former marketing agent has injected this bombshell into their long-running legal battle. She recently filed court documents that ask Williamson to admit that he and/or members of his family received illegal benefits from Nike, Adidas, and possibly others to attend Duke. If true, this could have far-reaching repercussions. Daniel is joined by Warren Zola and Darren Heitner to discuss this latest development.

He also addresses the controversial decision to reduce disability benefits for former hundreds of former NFL players. Ep41: The Forgotten 400

Conduct Detrimental: THE Sports Law Podcast

play

04/27/20 • 41 min

The NFL’s new collective bargaining agreement has been criticized as not providing the players with nearly enough economic gains to justify acquiescing to a 17th game. But the most controversial aspect of the new CBA is its treatment of the most vulnerable group of players: the roughly 900 or so former players who are receiving “total and permanent” disability benefits under the NFL’s disability plan. In this episode, Dan takes a closer look at how the new CBA could leave hundreds of former players out in the cold by removing them from the NFL’s disability plan or significantly reducing their benefits.

Manfred's New Comments & the MLBPA Grievance

Conduct Detrimental: THE Sports Law Podcast

play

07/02/20 • 44 min

The Dans break down the legal significance of MLB Commissioner Rob Manfred's recent comments the Dan Patrick Show, particularly when he said "the reality of the situation is we weren't going to play more than 60 games no matter how the negotiations with the players went."

Surely, these comments are ill-advised when he's staring down a bad faith grievance suggesting that he intentionally delayed negotiations. The Dans debate the union's case and discuss the underlying anatomy of the ~$1B grievance.
