Ep49: MLB's Legal Questions with The Athletic's Evan Drellich, UA v. UCLA, Patriots Punished (again)
Conduct Detrimental: THE Sports Law Podcast
06/29/20 • 58 min
Is baseball really back? The Athletic's MLB Analyst Evan Dreillich drops in to give us the scoop on: nuclear grievances, anatomy of opt outs, what happens if an Orlando Pride outbreak occurs and, lastly, what’s in the letter Manfred sent to the Yankees about sign-stealing that's the subject of ongoing litigation.
The big story in college is Under Armour who signed on with UCLA for the largest contract in college sports history and now wants to break it. We’ll explain and also cover the punishment handed out to the New England Patriots for yet another videotaping scandal. Fair or unfair - you be the judge!

Ep46: Zion Williamson Court Ruling
Conduct Detrimental: THE Sports Law Podcast
06/02/20 • 37 min
A Miami judge has denied Zion Williamson’s request to delay discovery into Gina Ford’s allegations that he received improper economic benefits to attend Duke. As a result, Williamson must now answer these questions under oath within the next 2 weeks. That is, unless Williamson’s attorneys file an immediate appeal, which is expected. Sports law expert Dan Lust joins me to break down the court ruling and discuss the likely next steps, including a possible appeal and whether it will be successful.

Ep44: What’s next for Zion Williamson and Duke?
Conduct Detrimental: THE Sports Law Podcast
05/11/20 • 59 min
Did Zion Williamson receive improper payments or other economic benefits to attend Duke? His former marketing agent has injected this bombshell into their long-running legal battle. She recently filed court documents that ask Williamson to admit that he and/or members of his family received illegal benefits from Nike, Adidas, and possibly others to attend Duke. If true, this could have far-reaching repercussions. Daniel is joined by Warren Zola and Darren Heitner to discuss this latest development.

Ep43: Ben Meiselas vs. The NFLPA
Conduct Detrimental: THE Sports Law Podcast
04/29/20 • 49 min
Will there be litigation to invalidate the NFL’s new collective bargaining agreement? It sure looks that way. In an exclusive interview with Conduct Detrimental, attorney Ben Meiselas lays down the gauntlet to the NFLPA in a riveting, no-holds-barred interview. He discusses his imminent legal challenge to the CBA on behalf of a group of disabled former NFL players, and the next legal steps that he will take to restore the vested disability benefits for hundreds of disenfranchised former players.

Ep42: Lorenzo Alexander on the NFL CBA
Conduct Detrimental: THE Sports Law Podcast
04/28/20 • 39 min
NFLPA Executive Committee member Lorenzo Alexander joins Conduct Detrimental to discuss the NFL’s new collective bargaining agreement. In this episode, Lorenzo explains his reasons for voting against the CBA and why the proposed deal was sent to the full membership for a vote even though it had been rejected by the Executive Committee. He also addresses the controversial decision to reduce disability benefits for former hundreds of former NFL players. He calls this decision a “mistake” by both the NFL and NFLPA, and outlines his plans for restoring the benefits to those affected.

Ep41: The Forgotten 400
Conduct Detrimental: THE Sports Law Podcast
04/27/20 • 41 min
The NFL’s new collective bargaining agreement has been criticized as not providing the players with nearly enough economic gains to justify acquiescing to a 17th game. But the most controversial aspect of the new CBA is its treatment of the most vulnerable group of players: the roughly 900 or so former players who are receiving “total and permanent” disability benefits under the NFL’s disability plan. In this episode, Dan takes a closer look at how the new CBA could leave hundreds of former players out in the cold by removing them from the NFL’s disability plan or significantly reducing their benefits.

Manfred's New Comments & the MLBPA Grievance
Conduct Detrimental: THE Sports Law Podcast
07/02/20 • 44 min
The Dans break down the legal significance of MLB Commissioner Rob Manfred's recent comments the Dan Patrick Show, particularly when he said "the reality of the situation is we weren't going to play more than 60 games no matter how the negotiations with the players went."
Surely, these comments are ill-advised when he's staring down a bad faith grievance suggesting that he intentionally delayed negotiations. The Dans debate the union's case and discuss the underlying anatomy of the ~$1B grievance.
