Intentionally and falsely characterizing someone of having committed a crime is generally defamation per se, meaning that the person wrongfully accused is presumptively entitled to monetary damages. Even worse, when this kind of unmerited and gratuitous reputation destruction is done for reasons of personal profit—a few more YouTube bucks, for example--it would seem particularly contemptible behavior.
Today we explore the question of whether explicitly labeling former Deputy Eddie Duran’s shooting of Airman Roger Fortson as having “executed Fortson for exercising his Constitutional rights” might qualify as precisely this kind of defamation per se.
This question is, of course, prompted by the repeated publication of Attorney William Kirk, on his YouTube channel Washington Gun Law (WGL) of the explicit claim that Duran executed Fortson merely because he was exercising his Constitutional rights.

Law of Self Defense - If Only USCCA Had Done It Right: Part 1

The United States Concealed Carry Association (USCCA) along with its partner Delta Defense LLC purport to pay their members legal expenses if the member is involved in a use-of force event. Indeed, their sophisticated internet advertising campaigns frequently feature CEO Tim Schmidt assuring the public that "We've got your back!"

In recent years, however, USCCA has refused to meet that apparent obligation to its members. When asked about this the organization has either provided no particularly substantive reasons--e.g., "we just feel we're not obligated to do so"--or has made up an outrageously not credible explanation months after the fact--e.g., "actually that member preferred we not help them."

It is for these reasons that I'm personally unable to recommend USCCA in good faith to anybody seeking legal services coverage in a use-of-force context.

That said, there DO EXIST scenarios in which it would arguably be appropriate for ANY use-of-force legal services company to decline to provide coverage--and we'll explore one of those scenarios in the context of a recent New Mexico Supreme Court decision.

If THIS had been USCCA's explanation for its repeated failure to cover its members, they'd have had a point. Too bad for them, however, that this was NOT their explanation.

This past Sunday a 78-year-old Florida man, Edward Druzolowski, shot dead his neighbor, 42-year-old Brian Ford, during a confrontation over Ford cutting trees on the shooter's property.
This morning, prestigious Law Professor Jonathan Turley published a post on his blog about this event. Although in my experience Professor Turley generally produces world-class legal content--as his academic and legal success attest--this particular post struck me as effectively muddying and conflating a number of distinct use-of-force law doctrines and cases.
So, with all due respect to Professor Turley, today's Law of Self Defense show will attempt to bring clarity to the muddied waters in today's blog post of this confrontation.
