Millions protested following the horrific death of George Floyd, fed up with the treatment of black people all over the globe. Black Lives Matter becoming a campaign message to end oppression based on skin colour.
Australia's protest focused on 434 deaths of indigenous people whilst in custody, since 1991. "I can't breathe" screamed on our own shores as David Dungay was killed after being restrained by prison guards in Long Beach correctional facility.
We look at the issues surrounding the deaths of 434 Indigenous Australians to try and understand why things have not changed since the Royal Commission into Aboriginal deaths in custody in 1991.
Our conclusion: Our First Nations people simply have not been afforded the same opportunities as white Australia. The core of the issue being the sheer disadvantage that our indigenous people have and a systemic racism towards our First People.

Pell out of the cell

Galbally's LORE

play

04/11/20 • 47 min

Cardinal George Pell's conviction for child sex crimes was overturned by Australia's High Court, quashing charges against him.
Pell has been accused of child sex offences, has led unsatisfactory responses from the Catholic Church in the handling of victims of sex offences relating to the Church and has become a controversial figure head.
Setting our views aside, the highest Judges in Australian law determined Pell's trial did not meet satisfactory requirements to prove guilt.
This is explained in a discussion between Father and Son (and a glass of wine).

The thin blue line

"Unfortunately we get in the Police Force, individuals that see their position as being one of power that gives them an opportunity to abuse individuals.
What is critically important is that those individuals are dealt with appropriately."
David Galbally AM QC

There is a wide spread belief that the oversight of Police misconduct is not working in Victoria. The independent anti-corruption agency IBAC lacks the power and resources to effectively manage the review of complaints of Police misconduct and investigation into serious misconduct.
The result, a system that lacks integrity and trust to provide the necessary care and service to Victorian's who are assaulted by Police.

“Friendly reminder....Comedian raised money not lawyer, politician, accountant lady.. that is the boss of the world. (CB quote)
Celeste Barber has raised $51 Million to support areas affected by the bushfires that devastated Australia in the summer of 2019/20.
“I’m all like let’s just give it to all these different places" (CB quote)
"Turns out it’s not that easy because there’s laws or something involved” (CB quote)

After celebrating the tremendous achievement, the community realized that the funds raised were only permitted to be used by the benefactor of the campaign, the NSW Rural Fire Service, and only then for strict purposes defined in the governance of that organisation.
So the funds could be distributed to many other areas requiring help.
Enter - an outraged group of people alleging deception and annoyance at the amount of money locked up with the charity that was the benefactor of the fundraising campaign.
We now watch as Celeste and the NSW Rural Fire Service engage lawyers to attempt to redirect some funds to other area affected by the fires.

play

01/27/20 • 71 min

Lawyer X, Informant 3838: Nicola Gobbo was a barrister representing key players in Melbourne's gangland war. At the same time she was secretly passing information to Victoria Police.
Nicola is at the centre of one of the biggest furors the Australian legal system has seen. It has sparked a Royal Commission inquiry into Police handling of informers. We discuss the very interesting issues here where the Police use of informants have come under investigation and one high profile Lawyer's ethics are questioned.
All this potentially jeopardizing the conviction of some of Australia's most ruthless criminals.

Ristevski - The appeal

Galbally's LORE

play

01/26/20 • 5 min

Karen Ristevski vanished in June 2016. Her body was found 8 months later in Feb 2017 in bushland at Mount Macedon.
Her husband Borce was found guilty of killing Karen and was sentenced to 9 years to serve a minimum sentence of 6 years.
There was outrage, and rightly so. The sentence did not meet community standards. The Prosecution appealed the sentence and in early December 2019, the Victorian Court of Appeal re sentenced Borce to 13 years with a minimum period of 10 years.
We quickly revisit the first episode to discuss the result.

In August 2019, Victoria's Court of Appeal, delivered one of the most significant judgments in Australian legal history, dismissing Cardinal George Pell's appeal against convictions for five child sex offences.
My Father and I had been contemplating doing a podcast where we attempt to assist the community in understanding some of the more complex community issues that arise regularly. We decided to try our arm (whoops or chance our hand ;) ) at a podcast which will discuss a range of topics causing public outrage.
Over a glass of wine, father and son, will discuss a a range of topics. Via social media channels, we will review community opinion and discuss audience questions, all with the aim of explaining the issue to alleviate the outrage or as it might be highlight the issues.
The night before the appeal my father and I thought it was time to start our journey. This is a significant event in Australian history.
This is the pilot, an unedited or non produced version.
Forgive a little roughness, hope you enjoy our first discussion.

Israel Folau, Australian Rugby Union player, raised eyebrows with his on field brilliance and with his off field behavior by expressing views condemning transgender, homosexuals, same sex marriage and other community groups to hell.
The course of events following his sacking have caused public outrage and sparked a discussion about the line between free speech and discrimination.

This episode is supported by Swings & Roundabouts A cheeky, fun wine brand that is serious about wine.
Karen Ristevski vanished in June 2016. Her body was found 8 months later in Feb 2017 in bushland at Mount Macedon.
Karen's husband Borce, was identified as the main suspect following a series of miscommunicated facts or lies about his whereabouts following Karen's disappearance.
He would later be charged with murder and eventually plead guilty to manslaughter. He was sentenced to 9 years jail with a minimum of 6 years.
This perceived light sentence caused public outrage in a community fed up with domestic violence and sentencing lengths.
